Curfew Within the Village (Ordinance 91-5-1, Amended 05-05-1)
Curfew Regulations
Section I – Definition: “Adult person” as used in this section means a person 18 years or older. “Minor person” as used in this section is any person not an adult.
Section II: Curfew for minors under 16
It shall be unlawful for any minor fifteen (15) years or younger to be upon public streets, sidewalks, alleys, parks, playgrounds, places of amusement and entertainment, or other unsupervised places, between the hours of 11 p.m. to 6 a.m. of the following day, official city time, provided, however, that the provisions of this section do not apply to a minor accompanied by his parent, guardian, or other adult person having the care and custody of the minor or where the minor is upon an emergency errand, legitimate business, or activity directed by his parent, guardian or other adult person having the care and custody of such minor.
Section III: Curfew for minors between 16 and 18
It shall be unlawful for any minor no younger than 16 and older than 18 to be upon public streets, sidewalks, alleys, parks, playgrounds, places of amusement and entertainment, or other unsupervised places, between the hours of 11 p.m. to 6 a.m. of the following day, official city time, except on Fridays, Saturdays, and Sundays when the hours shall be 12:00 midnight to 6 a.m. the following day, official city time, provided, however, that the provisions of this section do not apply to a minor accompanied by his parent, guardian, or other adult person having the care and custody of the minor or where the minor is upon an emergency errand, legitimate business, or activity directed by his parent, guardian or other adult person having the care and custody of such minor.
Section IV: Responsibilities of Parents/Guardians
Whoever, being the parent, guardian or adult person having the care and custody of a minor child, shall allow or permit such minor to violate the provisions of Section II or Section III, inclusive, shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished as provided in Section VI.
Section V: Aiding or Abetting Violation of Curfew and Peddling Regulations
Any person who shall aid, abet, influence or encourage a minor to violate any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished as provided in Section VI.
Section VI: Penalty
Whoever violates any of the provisions of Sections I through V, inclusive, shall be fined not more than $100.
